Partner and promotion terms

These terms apply to the Pop Magics partner programme and to a creator partnership claimed at popmagics.com/partnership. They are an agreement between you and Piruz Afruz, MB (registration code 306655229), doing business as Pop Magics ("Pop Magics", "we", "us"). You accept them when you tick the boxes on the claim form. They sit beside the End User Licence Agreement, which covers your use of the software, and the Privacy Policy.

1. Claiming a partnership

• You claim a partnership with your name, your email address and a YouTube or Twitch channel that you control.
• We confirm your email address by a link, and your channel by a short phrase that you place on it or by looking at it ourselves.
• A person at Pop Magics approves or declines each claim. We may decline a claim without giving a reason.
• An invitation to claim is not an approval. Nothing is issued, and no referral code exists, before a claim is approved.
• One partnership per person and per channel.

2. What an approved creator receives

• The Creator plan free of charge for 12 months from approval, on the terms of the End User Licence Agreement. If your account already holds a Pop Magics licence, your existing plan continues instead and no second licence is issued.
• A personal referral code and link.
• The marketing kit: Pop Magics logos and banners for use in your content about Pop Magics.

After the 12 months you may subscribe to a paid plan or continue on the Free plan. There is no fee to join and we pay no sponsorship fee.

3. Referral commission

• Rate. You earn 25% of the amount a referred customer pays for a Pop Magics subscription, excluding taxes, on every invoice they pay during the 12 months that follow their first payment.
• Who counts as referred. A new customer who arrives at popmagics.com through your link and subscribes to a paid plan within 60 days. Where a customer has used more than one partner's link, the first one counts. Your own purchases do not count.
• When it becomes payable. A commission becomes payable 14 days after the customer's payment.
• Refunds. If a payment is refunded or charged back, the commission on it is reversed.
• Payout. Once your payable balance reaches €50 you can request a payout from your dashboard. We then email you to arrange the payment. You are responsible for any taxes on what you earn and for any invoice your own tax rules require.
• No promise of income. What you earn depends on who subscribes through your link. We promise no amount.

4. Promotion terms

• Honest demonstration. Show and describe Pop Magics as you find it. We do not script, review or approve what you publish.
• Disclosure. Whenever you show, mention or link to Pop Magics, tell your audience clearly that your plan was provided free of charge and that your link is a referral link from which you may earn. Use the disclosure tools of the platform you publish on, and follow the advertising and consumer rules that apply to you and to your audience.
• Accuracy. Do not state that Pop Magics does something it does not do, and do not present your opinion as ours.
• No trademark bidding. Do not buy advertising on the name "Pop Magics" or on misspellings of it.
• No spam. Do not send your link in unsolicited messages, and do not post it where it is not welcome.
• No fake reviews. Do not publish, or arrange for, reviews or ratings that are not genuine.
• No impersonation. Do not present yourself as Pop Magics or as its employee.

5. Names and content

• We give you a non-exclusive, revocable permission to use the Pop Magics name and the logos in the marketing kit, unaltered, in content about Pop Magics.
• What you publish remains yours. We will ask you before we reuse your content on our website or channels.
• We may name you as a partner only with your agreement.

6. The relationship

You are independent. Nothing here makes you our employee, agent or representative, and neither of us can bind the other. The partnership is not exclusive: you may work with anyone else.

7. Changes, suspension and ending

• You may end the partnership at any time by writing to support@popmagics.com.
• We may suspend or end a partnership, and withdraw the free plan, if these terms are broken, if a claim turns out to be false, or if referrals are obtained by fraud. We may also end the programme, or a partnership, with 30 days' notice by email.
• Commission already earned on genuine referrals before the end remains payable under section 3. Commission obtained by fraud or in breach of section 4 is not payable.
• We may change these terms. We will email partners at least 30 days before a material change takes effect. The version you accepted is recorded with your claim.

8. Liability

Each of us is responsible for what we ourselves publish. To the extent the law allows, our liability to you under these terms is limited to the commission payable to you. Nothing here limits liability that cannot be limited by law, or any right you have as a consumer.

9. Law

These terms are governed by the law of the Republic of Lithuania. If you are a consumer, the mandatory protections of the country where you live still apply to you.
